Litigation
Litigation is the traditional domain of the legal profession and at Van Diepen Van der Kroef the Litigation practice group is a core activity, being, indeed, the backbone of the firm. Clients can only be provided with high-grade advice as to their legal position if that advice is based on a sound experience of the daily practice of litigation. Pleading a party's position before a court is a specialist field of its own and there are only a few firms in the Netherlands that still offer a fully-fledged litigation practice group. Van Diepen Van der Kroef possesses a highly experienced Litigation practice group. The lawyers in the Litigation practice group are experts in proceedings on the merits of the case, on summary proceedings for provisional measures as well as arbitration and binding opinion procedures, as well as representing clients before disciplinary organisations. We also advise on appeals and provide legal representation in proceedings before the Supreme Court of the Netherlands. The lawyers in the Litigation practice group:
- are experienced, solution-oriented, negotiators
- understand the relationship between the cost of litigation and the result to be obtained
- represent clients in judicial proceedings at Cantonal Courts, District Courts, Courts of Appeal and the Supreme Court of the Netherlands
- represent clients at hearings before Disciplinary Councils or Councils of Appeal for professionals subject to disciplinary law (e.g. the Disciplinary Council and the Disciplinary Committee of the Netherlands Royal Institute of Chartered Accountants)
- represent clients at arbitration, binding opinion and mediation hearings
- attach assets in order to prevent removal from redress and contest attachments imposed by others
- enforce judicial and arbitral rulings and binding opinions in the Netherlands and abroad
